Almost all societies have some norms, beliefs, customs and traditions that are implicitly accepted by their members as conducive to their healthy development and well-being—infringement of these cherished norms and customs condemned as anti-social behaviour.

 

Thus, many writers have defined ‘crime’ as anti-social, immoral or sinful behaviour. However, according to the legal definition crime is any form of conduct that is declared to be socially and culturally harmful in a state and as such forbidden by law under pain of some punishment. Crime can be defined as an act or omission, which is unlawful, illegal or infringes provisions of law and which is punishable by law.

 

Concept

White-collar crime referred to as the crime committed/acted by the educated individuals belonging to a higher class of community during their occupation.

 

What differentiates white-collar crime from the ordinary or blue crimes. It is also called as the crime of professional and educational elites. The common types of white-collar crimes emerged in India since last few years and how this has converted into a socio-economic crime. Besides this, some crimes are included in different professions such as medical, education and other legal professions. This information highlights several legislations of Indian law which discusses about the punishment of these sort of crimes.

 

White-collar crime is committed by the individuals who belong to the higher class of the society and are from the reputed group of society. This crime is committed during the occupation. Usually, the individuals who are committing these crimes have a better understanding of information technology, their respective field and disciplines. White-collar crimes have mainly emerged for a few years, and they are observed to be committed in big organizations which cover a large number of activities. Therefore, we can say that these crimes are general to trade, education, commerce, health etc. As the criminal profile has increased a lot in recent years, the traditional crimes have somewhat switched by the white-collar crimes across the country. The main difference between the blue and the white crime is that the ordinary, i.e. the criminals of blue crimes are individuals of underprivileged class and upper class is associated with white-collar crime. They commit a crime in an organized manner. They maintain b their respect in the society until the crime is discovered.

Effects of White-Collar Crimes

White-collar crime can have a massive impact on the community, and it does not just affect the criminals. It is called as a socio-economic crime as well because it has a direct effect on the community. When a white-collar crime is done huge losses on business transpire which have a direct impact on the users and the society. There are several numbers of scams and frauds that had been exposed in our country since the past few years such as 2g scam, banking scam, havala scam, fodder scam and many more. Due to these scams and frauds, the economy of our country has changed. To make up these losses of scams or frauds, they increase the costs. It means higher cost for the consumers in the way of higher taxes, increased insurance cost and government revenue. The impact of white-collar crimes on society is massive. There is loss in all field from the costs of goods and commodities to the insurance and securities. One financial fraud can affect the investor, businesspeople and the government. It is one bad employee who out of greed of money will commit a financial fraud and will cause harm to the reputation of the company, gain of losses and lack of profits.
